By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility and Account Registration
CruiseCtrl is a business-to-business platform. You must be at least 18 years old and authorized to act on behalf of a business entity to use the Services.
You agree to provide accurate, complete, and current information during registration and to keep your account information updated.
You are responsible for all activity that occurs under your account.
2. Description of Services
CruiseCtrl provides software tools designed to support lead follow-up, pipeline management, communication workflows, and revenue recovery for service-based businesses.
Certain features may include SMS or other telecommunications functionality subject to carrier rules and regulatory requirements.
CruiseCtrl does not guarantee message delivery, response rates, or revenue outcomes.
3. SMS and Telecommunications Use
a. Compliance Responsibility
You acknowledge that you are solely responsible for ensuring that your communications comply with all applicable laws, regulations, and carrier requirements, including but not limited to:
• TCPA
• CAN-SPAM
• A2P 10DLC rules
• Applicable state and federal regulations
b. Opt-In Requirement
You represent and warrant that you have obtained proper consent from message recipients before sending SMS messages using the Services.
You may not send messages to purchased lists, scraped contacts, or recipients who have not explicitly or implicitly consented.
c. Prohibited Messaging
You may not use CruiseCtrl to send:
• Unsolicited or deceptive messages
• Spam or mass cold outreach
• Messages related to illegal, fraudulent, or prohibited activities
• Content that violates carrier or platform policies
CruiseCtrl reserves the right to suspend or terminate messaging access at its sole discretion to protect platform integrity.
4. Account Suspension and Termination
CruiseCtrl may suspend or terminate your account immediately if:
• You violate these Terms
• You engage in prohibited messaging behavior
• Your activity threatens deliverability or compliance
• Required compliance information is inaccurate or incomplete
You may cancel your account at any time. Fees paid are non-refundable unless otherwise stated.
5. Fees and Payments
Certain features require payment. By subscribing, you agree to pay all applicable fees in accordance with the pricing presented at the time of purchase.
Failure to pay may result in suspension or termination of Services.
All fees are non-refundable unless explicitly stated otherwise.
6. Data Ownership and Use
You retain ownership of your business data and communication content.
By using the Services, you grant CruiseCtrl a limited license to process, transmit, and store data solely for the purpose of providing and improving the Services and meeting compliance obligations.
CruiseCtrl does not sell customer communication data.
7. Intellectual Property
All software, branding, trademarks, and platform content associated with CruiseCtrl are owned by CruiseCtrl or its licensors.
You may not copy, modify, distribute, or reverse engineer any part of the Services without prior written consent.
8. Third-Party Services
CruiseCtrl may integrate with third-party providers, including telecommunications and infrastructure partners.
CruiseCtrl is not responsible for the availability, performance, or policies of third-party services.
Your use of third-party services is subject to their respective terms.
9. Disclaimer of Warranties
The Services are provided “as is” and “as available.”
CruiseCtrl disclaims all warranties, express or implied, including but not limited to:
• Merchantability
• Fitness for a particular purpose
• Non-infringement
CruiseCtrl does not warrant uninterrupted or error-free service.
10. Limitation of Liability
To the maximum extent permitted by law, CruiseCtrl shall not be liable for:
• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Carrier filtering, blocking, or delivery failures
CruiseCtrl’s total liability for any claim shall not exceed the amount paid by you to CruiseCtrl in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless CruiseCtrl from any claims, damages, losses, or expenses arising out of:
• Your use of the Services
• Your communications or messaging practices
• Your violation of laws, regulations, or these Terms
12. Governing Law
